Terms of Service

Welcome to icco.in. By using our platform, you agree to these Terms of Service. Please read them carefully. If you do not agree, please do not use the platform.

1. About icco.in

icco.in (the "Platform") is operated by ICCO EMS, a company registered in India with its principal office at Office No 2, Shree Gajanan Park, Nashik Road, Nashik 422101 ("we", "us", "our"). The Platform helps users discover and book tickets for local events organised by independent third-party organisers ("Organisers").

2. Our role as an intermediary

icco.in is an intermediary as defined under Section 2(w) of the Information Technology Act, 2000. We provide a platform that connects Attendees and Organisers but we do not organise, host, sponsor, endorse, or guarantee any event listed on the Platform.

The Organiser is solely responsible for the event itself, including its quality, safety, content, accuracy of listing, conduct at venue, attendee experience, refunds, and compliance with applicable laws.

3. Eligibility

You must be at least 18 years old to register an account, list events as an Organiser, or make bookings without parental supervision. By using the Platform, you confirm you have the legal capacity to enter into a binding agreement.

4. Account responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorised use. We may suspend or terminate accounts that violate these Terms.

5. For Attendees

• You agree to provide accurate booking information.
• Bookings are confirmed when you receive a booking code. Show this at the venue for entry.
• Tickets are non-transferable unless the Organiser explicitly permits transfer.
• For paid events: refunds are governed by the Organiser's refund policy and our Refund Policy.
• For free events: bookings are not refundable but may be cancelled up to the event start time.
• You agree to follow all venue and Organiser rules at the event.
• The Platform is not responsible for losses, injuries, or damages arising from event attendance.

6. For Organisers

• You confirm that you have all necessary rights, permits, and approvals to host the event.
• You will provide accurate, complete, and non-misleading event information.
• You are solely responsible for the event's content, quality, safety, and conduct of attendees and staff.
• You are responsible for processing refunds when required (event cancellation, no-shows by you, etc.).
• You must honour all valid bookings and must not deny entry to attendees with a valid booking code without lawful reason.
• You will not list events that are illegal, obscene, defamatory, infringing, or otherwise harmful.
• You grant icco.in a non-exclusive, royalty-free licence to display your event listing, including text, images, and Organiser name, for the purpose of marketing and operating the Platform.
• The Platform may remove any event listing that violates these Terms or applicable laws.

7. Pricing & fees

For the first 24 months from launch, icco.in does not charge Organisers any platform commission or listing fee for hosting events. After this period, fees may apply, with at least 30 days' written notice provided via email. Payment processing fees (if any) charged by third-party payment gateways are pass-through and are not retained by icco.in.

8. Prohibited content & conduct

You agree not to:

• Post or promote events that are illegal, fraudulent, or violate any law of India.
• Impersonate any person or entity or misrepresent affiliation with any person or entity.
• Use the Platform to send spam, phishing messages, or unsolicited promotions.
• Attempt to interfere with the Platform's security, infrastructure, or other users' use.
• Scrape, copy, or republish data from the Platform without prior written consent.
• List events that promote violence, hatred, discrimination, or harm to any group or individual.

9. Intellectual property

All Platform code, design, branding ("icco.in", "icco" name and logos), and content created by us are owned by [Operating Entity Name] and protected under Indian and international IP laws. Content uploaded by Organisers and Users remains owned by them, but is licensed to us as described in these Terms.

10. Disclaimers

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or secure. We do not endorse or guarantee any event, Organiser, or third party listed on the Platform.

11. Limitation of liability

To the maximum extent permitted by law, icco.in and its operators, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or relating to your use of the Platform or any event accessed through it. Our total aggregate liability for any claim shall not exceed the greater of (a) the amount you paid to us in the twelve months preceding the claim, or (b) ₹5,000.

12. Indemnification

You agree to indemnify and hold harmless icco.in and [Operating Entity Name] from any claims, damages, losses, or expenses (including legal fees) arising from your breach of these Terms, your event content, or your use of the Platform.

13. Termination

We may suspend or terminate your access to the Platform at any time, with or without notice, for any breach of these Terms or any conduct we determine, in our sole discretion, to be harmful to the Platform, its users, or third parties.

14. Governing law and jurisdiction

These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts at [City, State], India.

15. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated via email or via a notice on the Platform. Continued use after such notice constitutes acceptance of the revised Terms.
